Understanding the Federal Court System
As a trusted criminal defense lawyer in Houston, with more than three decades of experience navigating the intricate web of the Federal Court System, I’m often asked about how the process works. It’s understandable — the system can seem like a labyrinth to those not familiar with its intricacies. Let’s break it down together, one step at a time.
The Structure of the Federal Court System
You might think of the Federal Court System as a three-tiered pyramid. At the base, you’ll find 94 U.S. District Courts spread across the country. Above them are the U.S. Courts of Appeals, 13 in total. Sitting at the apex of the pyramid is the U.S. Supreme Court.
U.S. District Courts
The Courts of Original Jurisdiction
When facing federal criminal charges, your journey through the justice system will start at a U.S. District Court. It’s here that the trial happens — where your defense team at The Law Office of Tad Nelson & Associates will present your case before a judge or a jury.
For example, Houston is part of the Southern District of Texas. It’s one of four federal judicial districts in our state. All initial proceedings, motions, and the trial itself take place here.
U.S. Courts of Appeals
The Intermediate Appellate Courts
Suppose you believe the District Court decision was unjust or that a legal error occurred. In that case, you may appeal to the U.S. Court of Appeals.
Texas falls within the Fifth Circuit, which also covers Louisiana and Mississippi. The appellate courts don’t conduct a new trial but review the District Court’s decision for any legal errors.
If any legal errors are uncovered, it could be grounds to have your case overturned.
Attorney Tad Nelson and the staff at the Law Offices of Tad Nelson & Associates takes great pride in helping defendants get wrongful convictions overturned. If you need help and feel that you or a loved one were unlawfully convicted in federal court, contact our law firm today.
Supreme Court of the United States
The Court of Last Resort
The Supreme Court of the United States is the highest court in the land. It hears a limited number of cases on an annual bases. The cases normally accepted by the court are primarily those involving substantial federal or constitutional issues.
Although it’s rare for a case to make it all the way to the Supreme Court, there’s always a possibility that a federal case can have national implications that force the court to hear the case. If this happens with your case, or if it needs to, we’ll be there with you throughout the process. If you have questions, call us at 713-659-0909.
Our Job As Your Attorney in the Federal Court System
As your criminal defense lawyer, my responsibilities extend far beyond mere representation in court. It involves understanding the nuances of the Federal Court System, Federal Rules of Evidence, and Title 18: Federal Crimes & Criminal Procedure. Our objective is to use that knowledge to advocate for you effectively.
Here’s some insight into what that looks like in practice.
Initial Consultation and Case Evaluation
Our relationship begins when we meet and conduct our initial consultation. Here, we’ll discuss the circumstances surrounding your charges, potential defense strategies, and what you should expect moving forward. This is also an opportunity for you to get the answers to your most pressing questions.
We provide 100% free case evaluations, so don’t hesitate to contact our law firm to schedule a meeting.
Investigation and Preparation for Trial
Following our initial consultation, my team and I will meticulously investigate all the details and evidence associated with your case. We’ll gather evidence, interview witnesses, and work closely with you to build a robust defense strategy.
Although the Feds have over a 90% win ratio, a compelling defense strategy might compel the Department of Justice to consider an agreement we can all be happy with – or even a case dismissal.
Representing You in Court
From the U.S. District Court in Houston to the Fifth Circuit and potentially all the way up to the U.S. Supreme Court, I will be with you every step of the way. I will argue on your behalf, challenge the prosecution’s evidence, and strive to achieve the best possible outcome for your case.
